Case Study
Chelsea and Shawn are college students have been dating for several months, but they have not yet committed to dating each other exclusively. Chelsea informs Shawn while on a dinner date one night that she feels ready to have sex with him. Shawn agrees that he also feels ready. The two have a glass of wine each at dinner and decide to stop by a cocktail bar afterward. They each have two strong cocktails before returning to Shawn's apartment.
Shawn makes another cocktail for himself and Chelsea while they are hanging out at his apartment. After drinking her cocktail, Chelsea begins to kiss Shawn and he reciprocates her affection. Both Chelsea and Shawn feel somewhat intoxicated, but neither is losing consciousness or slurring their words. Without explicitly discussing what they are about to do, Chelsea and Shawn have sex. The next morning, Shawn remembers the details well, but Chelsea's recollection is fuzzy.
-Did Chelsea and Shawn have consensual sex? Does the fact that Chelsea initiated kissing Shawn show that she consented to sex? Is it morally relevant than Shawn made Chelsea a cocktail before they had sex?
